Duffer Hollow Designs LLC (“Duffer Hollow Designs,” “we,” “our,” or “us”) operates the website located at dufferhollowdesigns.com (the “Site”) and provides custom shade structure design, fabrication, and installation services (the “Services”). This Privacy Policy describes what personal information we collect, how we use and protect it, who we share it with, and what rights you have regarding your information.
By accessing our Site, submitting a form, using our live chat feature, or otherwise engaging with our Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the practices described here, please discontinue use of our Site.

2.1 Information You Provide Directly
We collect personal information that you voluntarily provide when you interact with our Site or Services, including:

We do not currently purchase or receive personal information about you from data brokers or third-party sources. If this changes in the future, we will update this Policy before doing so.

We use the information we collect for the following specific purposes:
- To Respond to Inquiries: processing and replying to your contact form submissions, quote requests, and chat messages.
- To Deliver Services: coordinating shade structure design, fabrication, installation, and related project communications.
- To Send Communications: delivering newsletters, service updates, and promotional materials you have opted into. You may unsubscribe at any time.
- To Improve Our Site: analyzing usage patterns to improve site navigation, content, page performance, and user experience.
- To Maintain Security: detecting and preventing fraud, unauthorized access, and other harmful activities on our Site.

4. How We Share Your Information
4.1 Service Providers
We share personal information with the following categories of service providers who assist in operating our business. Each provider is contractually required to use your information solely for the purposes of performing services on our behalf and to maintain appropriate security measures:
- Website and CRM Platform: our Site is hosted and managed through HighLevel (GoHighLevel.com), which processes form submissions, chat interactions, email communications, and contact management on our behalf.
- Web Design and Development Agency: Primagery built and maintains our website and may access Site data in the course of providing technical support, updates, and maintenance.
- Payment Processing (if applicable): if we implement online payment functionality in the future, transactions will be processed by a PCI-compliant third-party processor such as Stripe. We will not store credit card numbers on our servers.
- Email Delivery: transactional and marketing emails are sent through HighLevel’s integrated email infrastructure (LeadConnector/Mailgun).
4.2 We Do Not Sell Your Personal Information
Duffer Hollow Designs does not sell, rent, lease, or trade your personal information to any third party for monetary or other valuable consideration. This applies to all categories of personal information we collect.
4.3 Legal and Safety Disclosures
We may disclose your information if we believe, in good faith, that disclosure is necessary to:
- Comply with applicable law, regulation, legal process, or enforceable governmental request.
- Enforce our Terms of Service or other agreements.
- Protect the rights, property, or safety of Duffer Hollow Designs, our customers, or the public.
- Detect, prevent, or address fraud, security, or technical issues.
4.4 Business Transfers
If Duffer Hollow Designs is involved in a merger, acquisition, or sale of all or a portion of its assets, your personal information may be transferred as part of that transaction. We will notify you by posting a prominent notice on our Site for at least thirty (30) days before any such transfer takes effect and before your personal information is subject to a different privacy policy.
5. Data Retention
We retain your personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, including:
- Contact and quote request data: retained for the duration of any active project and for three (3) years after the last communication, unless you request earlier deletion.
- Chat conversation logs: retained within our CRM platform for up to two (2) years.
- Newsletter subscriber information: retained until you unsubscribe or request removal.
- Automatically collected data (analytics, cookies): retained for up to twenty-six (26) months, consistent with standard analytics retention periods.
When personal information is no longer needed, we will delete or de-identify it. If deletion is not immediately possible due to backup systems, we will isolate the data and protect it from further processing until deletion is feasible.
6. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:
- SSL/TLS encryption on all pages of our Site (HTTPS).
- Access controls limiting employee and contractor access to personal information on a need-to-know basis.
- Secure hosting through HighLevel’s infrastructure, which maintains SOC 2 compliance and ISO 27001 certification.
- Regular review of data collection, storage, and processing practices.
No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. If you become aware of any unauthorized access to your data, please contact us immediately.
7. Cookies and Tracking Technologies
Our Site uses cookies and similar technologies for the following purposes:
- Essential Cookies: required for core site functionality, including form submissions, chat widget operation, and session management. These cannot be disabled without impairing site functionality.
- Analytics Cookies: used to understand how visitors interact with our Site, including pages visited, time on site, and navigation paths. This data is collected in aggregate and does not identify you personally.
- Preference Cookies: store your choices (such as chat widget state) to provide a more personalized experience on return visits.

8. Your Rights and Choices

- Request Deletion: ask us to delete your personal information, subject to certain legal exceptions (e.g., information needed to complete a transaction or comply with a legal obligation).

8.2 California Residents — CCPA/CPRA Rights

- Right to Delete: you may request deletion of your personal information, subject to exceptions permitted by law.
- Right to Correct: you may request correction of inaccurate personal information.
- Right to Opt Out of Sale or Sharing: we do not sell or share (as defined by the CCPA) your personal information for cross-context behavioral advertising. No opt-out is necessary because we do not engage in these practices.
- Right to Non-Discrimination: we will not deny you services, charge different prices, or provide a different level of service because you exercised your CCPA rights.

8.3 Other State Privacy Laws
Several U.S. states have enacted or are enacting consumer privacy legislation, including Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and others. If you are a resident of a state with applicable privacy legislation, you may have rights similar to those described above. 9. Children’s Privacy
Our Site and Services are not directed at individuals under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If we learn that we have collected personal information from a child under 16 without verifiable parental consent, we will delete that information promptly. 10. Third-Party Links
Our Site may contain links to third-party websites, including our social media profiles on Facebook, Instagram, and LinkedIn. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any external site before providing your personal information. We are not responsible for the privacy practices or content of third-party websites.
11. Do Not Track Signals
Some web browsers transmit “Do Not Track” (DNT) signals to websites. Because there is no universally accepted standard for how to respond to DNT signals, our Site does not currently respond to DNT browser signals. However, you can manage your tracking preferences through your browser’s cookie settings as described in Section 7.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will: (a) update the “Last Updated” date at the top of this Policy; (b) post the revised Policy on our Site; and (c) for significant changes, send a notice to the email address associated with your account or display a prominent notice on our Site at least fifteen (15) days before the changes take effect.
Your continued use of our Site after the effective date of a revised Policy constitutes your acceptance of the updated terms.
